Jailing Aurukun rapists could act as 'circuit breaker'

Queensland's Chief Justice has told the Court of Appeal in Brisbane that sentencing nine rapists to jail or detention may act as a "circuit breaker" to stop further offences.

The three men and six juveniles pleaded guilty to raping a 10-year-old girl at Aurukun in far-north Queensland in 2006.

All were given non-custodial sentences.

The State Attorney-General is appealing against the leniency of the sentences, saying they are inadequate.

Defence lawyer Ken Fleming told the court the sentences were appropriate and the appeal should be dismissed, arguing that custodial sentences would do nothing for the males' rehabilitation.

Chief Justice Paul de Jersey said jail or detention could act as a "circuit breaker" and stop the cycle of re-offending by the males.

He said it was important to protect the community but also take into account the rules of sentencing.

The three judges have reserved their decision.
