Florida's most famous judge is expected to decide Wayne Carey's fate tomorrow, when the retired AFL star's US police assault case is finalised in court.

Carey faces up to 15 years in jail for allegedly kicking one Miami police officer in the lip and elbowing another in the face during a row with girlfriend Kate Neilson in Miami a year ago.

However it is believed Carey's high-priced Miami lawyer has negotiated a sweet plea deal with Florida prosecutors that will allow him to avoid jail.

It is believed Carey will only have to pay a fine of $US500 ($718).

However Judge Rosa Rodriguez will have the final say on any deal.

The judge, known worldwide for presiding over the custody and immigration battle involving Cuban boy Elian Gonzales in 2000, has the power to reject any plea deal and sentence Carey to what she believes is suitable.

The case is scheduled to begin at 1.30am (AEDT).
